LICENSING EVENTS.
It has come to my attention that NT and EH who are the joint custodians of the Avebury complex have recently mooted their intention to licence events and Gatherings.
This 'licence' appears to be based on 'Permissive' authority.
I would point out that ANY Pagan gatherings of a celebratory nature can trace its Origins, Custom, and Use back to a time known in Law as, 'Time Immemoral' and therefor no such Permission is required.
I shall therefor be advising Pagan Groups and Gatherings throughout these Isles NOT to apply and to challenge the legal requirement for any such Licences.
LEGAL DEFINITIONS
CUSTOM
A rule of conduct, obligatory on those within its scope, established by long usage.
A valid custom must be of immemorial antiquity, certain and reasonable, obligatory, not repugnant to Statute law though it may derogate from common law.
General Customs are those of the whole country, for example’ the general custom of merchants.
Particular customs are the usage of particular trades
Local Customs are customs of certain parts of the country
USAGE
A uniformity of conduct of persons with regard to the same act or matter. A usage may harden into custom.
TIME IMMEMORIAL
Term used to denote a time before legal memory.
The Statute of Westminster 1275 fixed it at 1189
